1.- User Obligations
These Terms of Use apply to the use of the public section of the Website by any User.
Users undertake to make proper use of the Website in accordance with the law and this Legal Notice. The User shall be liable to Datfor or to third parties for any damages that may arise as a result of a breach of this obligation.
The use of the Website for purposes that are harmful to Datfor’s assets or interests, or that in any way overload, damage, or render unusable Datfor’s or third parties’ networks, servers, computer equipment (hardware), or software applications, is expressly prohibited.
2.- Intellectual and Industrial Property
The Website, including its graphic design and its contents — which, by way of example and without limitation, include data (including measurements), texts, photographs, graphics, images, software, and other materials — is the intellectual property of Datfor or of third parties who have licensed such content to Datfor. No rights of exploitation recognized under applicable intellectual property laws shall be deemed transferred to Users.
In particular, Users must refrain from reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the contents, except where necessary for browsing the Website, in cases expressly permitted by law, or where explicitly authorized by Datfor under the terms and limitations set out in the relevant agreement entered into between Datfor and the User.
Distinctive signs (trademarks, trade names, etc.) are the property of Datfor, and access to the Website shall not be construed as granting Users any rights over such trademarks, trade names, or other distinctive signs.
3.- Disclaimer of Liability
3.1.- Service Availability
Datfor seeks to keep the Website operational and free of errors; however, the User agrees to use the Website at their own sole responsibility. The Website is provided “as is,” without any express or implied warranties. Except where legally required under applicable law, Datfor does not provide any warranties regarding merchantability or fitness for a particular purpose, nor does it guarantee uninterrupted access to or error-free use of the Website.
Access to the Website requires services and supplies from third parties, including transmission over telecommunications networks, whose reliability, quality, security, continuity, and operation are neither attributable to nor controlled by Datfor. Datfor shall not be liable for failures or disconnections in telecommunications networks or other third-party services that result in the suspension, cancellation, or interruption of access to the Website.
3.2.- Content and Services Linked Through the Website
The Website may include links that allow Users to access other websites and internet portals (hereinafter, “Linked Sites”). In such cases, Datfor acts as an intermediary service provider in accordance with Article 17 of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (“LSSI”), and shall only be liable for the content and services provided on Linked Sites where it has actual knowledge of their unlawful nature and has failed to disable the link with due diligence.
If a User considers that a Linked Site contains unlawful or inappropriate content, they may notify Datfor in accordance with the procedure and effects set out in Clause 5 of this Legal Notice. In no case shall such notification entail an obligation to remove the corresponding link.
Under no circumstances shall the existence of Linked Sites imply the existence of agreements with their owners or operators, nor endorsement, promotion, or identification by Datfor with the statements, contents, or services provided therein.
3.3.- Website Security
Connection to the Website is made through open networks; therefore, Datfor does not control the security of data communications or of the devices connected to the Internet. It is the User’s responsibility to have appropriate tools for the prevention, detection, and removal of harmful software or malware.

Datfor shall not be liable for damage caused to Users’ computer equipment during connection to the Website as a result of third-party actions, nor for the lack of security or confidentiality of information transmitted through third-party telecommunications networks, or as a consequence of vulnerabilities in Users’ own hardware or software.
4.- Reporting Unlawful or Inappropriate Activities or Services
If a User or any third party becomes aware that Linked Sites, content, or any other services provided through the Website are unlawful, harmful, defamatory, violent, immoral, or otherwise infringe third-party rights, they may contact Datfor by providing the following information:
Personal details of the reporting party: name, address, telephone number, and email address. Datfor will be responsible for processing the personal data voluntarily provided solely for the purpose of handling the request. Data subject rights may be exercised as set out in the Privacy Policy. Failure to provide any of this information may result in the request not being processed, without prejudice to any voluntary investigations Datfor may choose to carry out.
A description of the facts that reveal the unlawful or inappropriate nature of the service.
In the event of infringement of rights such as intellectual or industrial property, or any other rights whose existence cannot be inferred by Datfor, documentation proving the existence of the infringed right must be provided. Additionally, personal details of the rights holder must be supplied if they differ from the reporting party, together with proof of authorization to act on their behalf.
An explicit statement that the information contained in the complaint is accurate.
Receipt by Datfor of a notification under this clause shall not, in accordance with the LSSI, imply actual knowledge of the activities and/or content indicated by the reporting party.
5.- Data Protection and Cookies
Users who wish to know which data processing activities are carried out on the Website and which cookies are used may consult our Privacy Policy and Cookies Policy.
6.- Validity and Termination
Datfor reserves the right to make changes to this Legal Notice by publishing any amendments in the same manner as this Legal Notice or by any other appropriate means of communication to Users.
Accordingly, this Legal Notice shall remain in force for as long as it is published, until it is wholly or partially modified, at which point the amended Legal Notice shall enter into force. Users are therefore advised to carefully review this Legal Notice each time they access the Website.
Datfor may terminate, suspend, or interrupt access to the Website or to any services provided through it at any time, without prior notice and without Users being entitled to claim any compensation. Following such termination, the prohibitions on use of the content set out in this Legal Notice shall remain in force.
7.- Applicable Law
All matters relating to the Website and this Legal Notice shall be governed exclusively by Spanish law.
